美麗新淡海影城快撐不住 訴請208萬月租金打2折輸了
淡水的美麗新淡海影城,去年2月起受新冠肺炎影響,觀影人數雪崩式下滑,因此向房東
宏泰人壽提告,希望每月208萬餘元租金打2折,降為每月41萬多元。
台北地院簡易庭採信宏泰人壽主張,認為雙方簽約前,已就租金協調過營運風險,判決美
麗新敗訴,還可上訴。
美麗新主張,疫情嚴重影響影城收入,呈現大幅赤字,長期下來將無法繼續照顧17名員工
生計,也無法支應每月208萬餘元租金。此外,去年3月以後,美國電影供應商拒絕將「花
木蘭」、「007系列」等強片,在美國以外地區首映,導致國內電影院陷入無重量級新片
可放的窘境,讓票房收入雪上加霜,因此請求降租。
宏泰人壽則認為,雙方前約前,曾約定租金依影城當年度營業額多寡進行核算,若影城當
年度營運收益良好、營業額超過1.4億元部分應給房東抽成,若營運收益不如預期,美麗
新同意至少支付「包底租金」208萬多元,可見美麗新已對營運風險縝密估算,請求降租
並不合理。

底租金」,並未收取「抽成租金」,且宏泰人壽並未對其他承租人降租,卻刻意不降美麗
