李姓夫妻斥資千萬買了一間車庫型別墅,沒想到隔壁鄰居常把機車或汽車擋在他家門口,
害他們有車庫也沒地方停車,李多次檢舉無效,只好裝監視器蒐證,沒想到竟被鄰居一家
6口依違反個資法提告求償30萬,李姓夫妻看破賣房求安寧,法官也駁回鄰居之訴。
判決指出,2017年1月,李姓夫妻用打拚賺來的積蓄,買了一間車庫型別墅,剛搬到新家
不到2個月,李姓夫妻就發現,隔壁鄰居一家6口因有多輛汽機車,經常24小時擋住他家車
庫門口,他多次勸阻無效,只好報警處理。
但警方到場後,鄰居雖然會立刻把車移走,但警察前腳剛走,鄰居又會再把車子停到他家
門口,李姓夫妻不勘其擾,向警方求助後,員警建議他們可以裝監視器自行蒐證,再把鄰
居佔用車位的影片透過網路向警政單位檢舉開罰。
李姓夫妻聽從建議,在自家門口裝了4支監視器,並把蒐證而來的違規畫面,上傳給警方
後,鄰居被開了多次罰單,結果李姓夫妻的停車問題解決了,官司也隨之而來;鄰居陳姓
一家六口不滿被李姓夫妻「瘋狂」檢舉,認為他們裝監視器蒐證已違反個資法,向李姓夫
妻提告求償30萬元。
高雄地院審理時,李姓夫妻直嚷倒楣,還說自己剛搬新家就被鄰居滋擾多年,在2020年春
節前夕把新家賣掉,寧可搬走也不願再跟陳家當鄰居;法官勘驗監視器畫面,發現監視器
只是拍攝李男住家門口及道路,沒有朝鄰居家大門或屋內拍攝,因此認為沒有侵犯陳姓一
家六口權益,判陳家敗訴,可上訴。
