2003年，張五常夫婦在美國被控出售假古董和逃稅。一旦指控成立，張五常將面臨最高可
達83年的牢獄和475萬美元的罰款。但是張五常沒有出席美國西牙圖聯邦地區法院的審判
，他在事後的一份聲明中說，自己擔心遭到不公平的審判。於是，美國司法部和財政部向
張五常發出通緝令，並同時封存其在美國的價值1000萬美元的財產。由於香港和美國有引
渡協議，而大陸與美國沒有，因此張五常夫婦逃到中國大陸。
