築師公會鑑定,認為所採用鋼筋規格有部分與設計圖說不符,耐震能力僅有圖說的約9成
與8成4,故判建商等業者需賠7戶共約775萬餘元。
對此,不具名結構技師認為,監造、營造、市府委派查驗委員逐層驗收,卻仍有鋼筋與設
計圖不符情事發生,其中恐有疏失。房地產業內人員也說,建案爆出未按圖施工,建商恐
將賠上自己商譽。
陳男等7戶已購戶,陸續在2015~2018年間分別砸1050萬~1460萬,拆算車位單價約30~33萬
左右,向建商購得房地,因有住戶發現施工所用鋼材,與原設計圖說不符,管委會向台灣
省結構工程技師公會申請安全鑑定,抽查鋼材規格,發現從圖說的SD420,被換成降伏強
度較差的SD280 ,未按圖施工,故主張建物有建築強度不足的重大結構安全瑕疵,狀告建
商、營造、監造三方要求賠償。
建商答辯,為免鋼筋價格波動,按建築業慣例,在社區興建前已預訂鋼筋等建材,因未告
知結構技師,才發生施作與圖說不符的情形,直到看到鑑定報告才知此事。而建商、營造
與建築師均表示,報告顯示抗震能力無虞,故無重大結構安全瑕疵。
法院另委託北市建築師公會鑑定, 發現A、B棟耐震能力強度為核准圖說的89.96%,而C
棟為圖說的84.11%,建議需花費5580萬5149元補強,才可達原始設計圖強度,若不補強
,仍要辦理變更設計等流程,以符合相關法令,減少房價的影響,故認為建商、營造、建
築師等未篤實履行法定義務,需連帶負擔侵權行為損害賠償責任,賠償7戶87~117萬餘元
不等,一共計775餘萬元。
對於大樓未按圖施工一事,不具名結構技師表示,營造、監造、市府委派查驗委員等三方
,依規定逐層查驗建物並給予簽核,才能夠通過驗收取得使照,該大樓未按圖施工,卻能
驗收過關,其中恐怕有所疏忽。
土木技師、結構技師劉冠廷指出,全台僅北市規定在頂版勘驗時,需提交各階段樓層鋼材
出廠證明予市府備查,其餘縣市的一般消費者,無從查證鋼材是否符合圖說。推測該住戶
知情申請鑑定,恐怕事前有風聲傳出,才會進而揭發此事。
據悉,桃園近期有3、4個建案傳出未按圖施工,因監造方或主任技師,驗收時拒絕簽核才
爆出。劉冠廷表示,近2年鋼價上漲,近期常傳出有鋼材與設計圖不符等情事傳出。
《住展》雜誌研發長何世昌痛批,建案未按圖施工,負責找營造、建築師的建商要負很大
責任,不僅需賠償住戶外,更毀了自家商譽;除非住戶為專業人士,在施工時到工地監工
,或是有吹哨者揭發,否則在驗收端沒做好把關,一般人很難發現建案未按圖施工,另外
,近期有建案標榜採用建築安全履歷或建物生產履歷,或許能為建物結構安全多一道把關
。
