新北議員蘇有仁 當選無效定讞

（中央社記者賴又嘉、黃旭昇台北23日電）新北市議員蘇有仁因助理楊文忠涉賄，板橋地
檢署提當選無效之訴。法院一審認定蘇有仁知情且事前授意，判當選無效。台灣高等法院
審理，今天駁回蘇的上訴，全案定讞。
板橋地檢署當時提告指出，蘇有仁於去年5、6月競選新北市議會第1屆議員期間，僱請楊
文忠擔任特助及選舉後援會執行長，蘇並授意楊文忠透過他人蒐集選民名單行賄，板檢接
獲檢舉後，指揮檢調人員搜索相關人員住處，認定楊文忠為蘇有仁買票，因而對蘇提起當
選無效之訴。
楊文忠買票的刑事部份，高院合議庭今年8月間以違反選罷法判處楊有期徒刑2年、褫奪公
權2年。
蘇有仁遭提當選無效部分，法院一審時，認定蘇有仁對楊文忠行賄選民，不僅知情且同意
為之，認定2人有共同賄選的意思，判蘇有仁當選無效。
蘇有仁不服，提起上訴，今天遭高院合議庭駁回。全案定讞。
蘇有仁今天未接電話，但透過服務處表示，對於賄選一事並不知情，這些都是楊男的個人
行為。對於高院的判決確定，深表遺憾、無奈、失望。
新北市選委會表示，相關單位收到判決書後，若符合解職要件，將由行政院依照地方制度
法第79條，解除市議員職權。中選會將依照公職人員選舉罷免法，其缺額由落選人依得票
數之高低順序遞補。
蘇有仁將會是新北市議會第2名解職的議員，第11 選舉區當選人宋進財，因違反選罷法，
遭判刑3年6月、褫奪公權3年確定，行政院今年7月解除議員職權。中選會公告缺額由楊春
妹遞補。1000823
