小弟剛看完了哈佛及 MIT 的起訴書：

以小弟對美國法律的粗淺理解，週一的「七月六日指示」真的很可能會被撤銷掉。
按照原告方的理由，3/13 ICE曾發布一個給校方的緊急命令指示（http://t.ly/0UBq），
指示中提到：
" If a school closes temporarily but offers online instruction or another
alternative learning procedure, nonimmigrant students should participate in
online or other alternate learning procedures and remain in active status in
SEVIS. Schools must notify SEVP of COVID-19 procedural changes within 10
business days. Given the extraordinary nature of the COVID-19 emergency,
SEVP will allow F-1 and/or M-1 students to temporarily count online classes
towards a full course of study in excess of the limits stated in 8 CFR
214.2(f)(6)(i)(G) and 8 CFR 214.2(m)(9)(v), even if they have left the United
States and are taking the online classes from elsewhere. This temporary
provision is only in effect for the duration of the emergency and in
accordance with the procedural change documents filed in a timely manner to
SEVP."
這邊就說如果學校改成線上教學，那麼那些課程仍可算在 F-1 學生的全時在校
學分內，豁免 F-1 學生到校學習的義務；紅字部分可解釋為只要緊急狀態持
續，這建議會一直有效，這也是原告方在起訴中一直強調的，雖然指示的末段有
提到 "[d]ue to the fluid nature of this difficult situation, this
guidance may be subject to change"。
起訴書中比較有力的論點，是哈佛及 MIT 強調他們是 rely on 這個政府的行政
措施訂定接下來的政策，且這指示並非單純只是解釋其他政策的「解釋性規定」
（interpretive rule），而是會對校方及學生的權利有實際影響的「實質規定」
（substantive rule），但政府要改政策又沒先預告（就算之前的指示有說可能
會更改），不讓人民有陳述意見的機會及做相應的準備，造成校方及學生
"serious reliance interests"（重大信賴利益）的損失，且又沒有在此時必須
改變政策的正當理由（i.e., 就算原本指示有提到 subject to change，但現在
疫情仍然嚴峻，很多地方每日新增感染人數持續增加），特別是疫情現在完全沒
趨緩的時刻，在這時間點國際學生又不可能因此轉學去有 in-class learning
的學校，所以哈佛及 MIT 主張這個「七月六日指示」是不合法的（arbitrary
and capricious），所以請求麻州的聯邦地方法院發布禁令禁止七月六日指示的
執行，並請求將其撤銷。起訴書中還有一併提到這七月六日指示會造成明年即將
畢業的學生可能沒法拿 OPT 在美國工作的問題，以及到校上課會特別對年紀大
的老師及住宿舍的學生產生安全上的風險。
總之起訴書看下來沒什麼大問題，小弟覺得這個指示真的可能會被幹掉吧。看大
家有沒有其他看法。
